US trade panel says Apple did not violate Google patent

Apple had initially been accused of infringing on six patents for iPhone-related technology covering everything from reducing signal noise to programming the device's touch screen so a user's head does not accidentally activate it while talking on the phone.


If Apple had been found guilty of violating the patent, its devices could have been banned from being imported into the United States.
Google can appeal the decision to the U.S. Court of Appeals for the Federal Circuit. "We're disappointed with this outcome and are evaluating our options," the company said in a statement. A spokeswoman for Apple declined comment.
The smartphone industry has seen dozens of lawsuits on several continents as Apple vies for market share with companies that make smartphones that use Google's Android software.
Google acquired the patents in the case - and the lawsuit - when it purchased Motorola Mobility for $12.5 billion in 2012, partly for its library of telecommunications patents.
Google's Android software, which the company lets handset makers use for free, has become the world's No. 1 smartphone operating system, ahead of the iOS software used on Apple i Phones.
The ITC, a U.S. trade panel that investigates patent infringement involving imported goods, is a popular venue for patent lawsuits because it can bar the importation of infringing products and because it issues decisions relatively quickly.
Motorola Mobility, which has since been acquired by Google, accused Apple in 2010 of infringing on six of its patents. Two were terminated from the case, and the ITC said last August that Apple was innocent of infringing three others.
But the commission had also asked its internal judge, Thomas Pender, to reconsider its finding that Apple did not violate a fourth patent, which is for a sensor to monitor the location of a user's head to keep it from maneuvering on the touch screen. Pender found that patent obvious in December, and the full ITC came to the same conclusion on Monday.

Gesi utata mtupu

SAKATA la ujenzi wa bomba la kusafirisha gesi asili kutoka Mtwara hadi Dar es Salaam, linaendelea kuwa utata mtupu kwa Serikali ya Chama cha Mapinduzi (CCM) kutokana na usiri uliotanda mradi huo.
Rasilimali hiyo imezua vurugu kubwa mkoani Mtwara hivi karibuni na kusababisha vifo vya watu kadhaa pamoja na uharibifu wa mali za serikali na viongozi wa kisiasa, huku wananchi wakitaka waelezwe jinsi watakavyonufaika.
Hata hivyo, utata mkubwa umenza kujitokeza katika suala hilo kutokana na wawekezaji wa mradi huo kutishia kujitoa endapo mgogoro huo usipopatiwa ufumbuzi haraka.
Tanzania Daima Jumatano limedokezwa kuwa, kutokamilika kwa sera ya gesi ni sababu mojawapo inayochangia kukuza mgogoro huo kwani hadi sasa haijulikani nani ananufaika katika nini kama ilivyo kwenye mataifa jirani yenye sera za gesi.
Pia mgongano wa kimaslahi miongoni mwa vigogo wa CCM unatajwa kuwa chimbuko lingine la vurugu za Mtwara, kwani baadhi ya vigogo wa juu serikalini na kwenye chama wanadaiwa kuwa na uhusiano na makampuni yanayotaka kuchimba gesi hiyo.
Katika kile kinachoonekana kama mkakati wa serikali kufifisha hoja hiyo, tayari mizengwe imefanyika na kulishawishi Bunge lisiruhusu wabunge kujadili suala hilo.

Spika wa Bunge, Anna Makinda ametangaza kuzikataa hoja binafsi zinazolenga kujadili sakata la gesi asilia mkoani Mtwara, jambo lililotafsiriwa kama njama ya kutaka kuwaziba midomo wabunge.
Makinda alitoa uamuzi huo wa kutojadili suala hilo bungeni kwa madai kuwa ni zito na nyeti, linalopaswa kujadiliwa kwa hekima kubwa na busara ya kutosha ili kupata muafaka wa kweli.
Aliliambia Bunge jana kuwa, kutokana na unyeti wake ataunda tume bila kubainisha itakuwa ya watu wangapi ambayo itazungumza na wananchi wa Mtwara pamoja na viongozi wa serikali na makundi mbalimbali na baadae itarejesha majibu bungeni na ndipo suala hilo litaweza kujadiliwa.
“Nimefikiria sana kuhusu suala la gesi, nimeona hakuna sababu yoyote ya kuwepo kwa hoja binafsi wala kuruhusu wabunge walijadili suala hilo hapa bungeni, bali busara ni kuundwa tume ambayo itafanya kazi ya kufuatilia suala hilo kwa makini na kupata majibu,” alisema.
Makinda aliongeza kuwa, tume hiyo itafanya kazi ya kuzungumza na wananchi pamoja na makundi mbalimbali mkoani Mtwara, wakiwemo pia viongozi wa serikali na baadae itarejesha majibu ambayo yatawasilishwa bungeni.
Alisema tume hiyo ni lazima ifanye kazi ya kuzungumza na kubaini tatizo ni nini ili liweze kupatiwa ufumbuzi badala ya kujadili jambo ambalo kiini chake hakijulikani sawa sawa.
Kwamba tume itahakikisha inaleta majibu mapema iwezekanavyo katika Bunge linaloendelea mjini hapa.
Mawaziri wakinzana
Wakati spika akizima hoja hiyo kiaina, Waziri wa Nishati na Madini, Prof. Sospeter Muhongo na Naibu wake, George Simbachawene wametofautiana kuhusu gharama halisi za ujenzi wa bomba la gesi asilia toka Mtwara hadi Dar es Salaam.
Prof. Muhongo alisema gharama halisi za ujenzi wa bomba hilo ni dola za Kimarekani bilioni 1.2 wakati naibu wake aliwaambia wahariri wa habari mwishoni mwa wiki iliyopita kuwa gharama halisi za mradi huo ni dola milioni 875,715.
Simbachawene alikwenda mbali zaidi na kumtuhumu mbunge wa Kigoma Kaskazini, Zitto Kabwe (CHADEMA) kuwa anapotosha mradi huo na kuchochea wananchi kutokana na kukosa uzalendo.
Hata hivyo, Zitto alikataa kubishana na naibu waziri huyo kwa sasa akidai hawezi kufanya hivyo wakati nchi inaungua, na hivyo kuhoji usiri katika mkataba huo ni wa nini kama si kwamba serikali inaashiria kuficha kitu.
Katika mazungumzo yake na Tanzania Daima Jumatano, kwa njia ya simu jana, Waziri Muhongo alifafanua utata huo akisema haiwezekani naibu wake akatoa taarifa kama hiyo wakati tayari walishasema gharama halisi.
“Hata ukienda kwenye kumbukumbu za Bunge, hiyo ndiyo gharama halisi na tulishaomba mkopo kutoka Benki ya Exim ya China, hivyo naibu wangu hawezi kusema takwimu hizo unazonitajia,” alisema.
Kuhusu utekelezaji wa mradi wa mpango kabambe wa umeme nchini (Power System Master Plan) wa kujenga kituo cha kufua umeme 300MW Mnazi Bay, Mtwara na kujenga msongo wa umeme wa 300KV hadi Singida ambao Rais Jakaya Kikwete alipokea ripoti ya ujenzi wake Oktoba 12, 2011, Muhongo alisema hawezi kuuzungumzia.
“Sasa ni mwaka 2013, siwezi kuzungumzia vitu vya mwaka 2011, kuna mabadiliko mengi yameshafanyika,” alisema.
Rais Kikwete alipokea ripoti ya ujenzi wa mradi huu kutoka makampuni ya China National Machinery & Equipment Import & Export Corporation (CMEC) ya China na Siemens ya Ujerumani, ambayo kwa pamoja yalitarajia kujenga kituo kikubwa cha kuzalisha umeme kutokana na gesi katika eneo la Mnazi Bay, mjini Mtwara.
Mradi huo ungehusisha kujenga njia ya kusafirisha umeme ya kilomita 1,100 kutoka Mtwara hadi Singida na ungegharimu dola za Kimarekani milioni 684 na Rais aliagiza utekelezwe haraka sana.
Ni katika utata huo Zitto alimtaka Waziri Muhongo afafanue mradi huo uliishia wapi na kwanini serikali ipo kimya kuhusu mradi huu ambao ungejibu kabisa maswali ya watu wa Mtwara.
CHADEMA yambana Kinana
Chama cha Demokrasia na Maendeleo (CHADEMA) kimesema kuwa kauli za Katibu Mkuu wa Chama Cha Mapinduzi (CCM), Abdulrahman Kinana na Katibu wa Itikadi na Uenezi, Nape Nnauye za kuitaka serikali ikae na wananchi wa Mtwara sasa ni za kinafiki.
Hatua hiyo inakuja siku moja baada ya viongozi hao kunukuliwa na vyombo vya habari wakiitaka serikali ikae na wananchi wa Mtwara na kusikiliza madai yao katika sauala zima la gesi asilia.
Mkurugenzi wa Habari na Uenezi wa CHADEMA, John Mnyika alisema unafiki wa kauli za Kinana na Nape unatokana na kukinzana na kauli za viongozi wenzao wa juu, yaani mwenyekiti wao, Rais Jakaya Kikwete na Makamu wake - Bara, Philip Mangula.
Mnyika alisema Rais Kikwete alinukuliwa na vyombo vya habari akipuuza madai ya watu wa Mtwara na kuwaita wachochezi walipoandamana kuhoji rasilimali yao.
“Kauli za kujikosha za Kinana na Nape haziwezi kurudisha nyuma vuguvugu la wananchi kufanya mabadiliko kwa kuiondoa CCM madarakani kupitia chaguzi za mwaka 2014 na 2015 na kuiunga mkono CHADEMA katika mpango mkakati wake wa mwaka 2013,” alisema.
Mnyika ambaye pia ni mbunge wa Ubungo, alisema kuwa CHADEMA imekuwa mstari wa mbele kupambana na ufisadi na kutetea rasilimali za taifa pamoja na kuwa na sera sahihi zenye kuwezesha maendeleo endelevu ya wananchi.
Alisema kwa kuzingatia misingi hiyo, kikao cha Baraza Kuu la dharura cha CHADEMA kiliazimia msimamo wa Kamati Kuu kuhusu mgogoro wa gesi Mtwara kwamba wanataka wananchi wasikilizwe na serikali isimamishe mchakato wa kuvuna gesi yao hadi itakapokuwa imetekeleza mambo kadhaa.
Mnyika alitaja mambo hayo kuwa ni kuweka wazi mikataba yote ya utafutaji na uvunaji wa gesi ili wananchi wajue inalinda maslahi yao na si kuwanufaisha viongozi wa CCM.
“Kwanini serikali haitaki kujenga vinu vya kufua umeme kwa kutumia gesi pale Mnazi Bay Mtwara, na kuingiza umeme wa 300 MW katika gridi ya taifa?
“CCM ijieleze kwa kushindwa kutekeleza ilani yake kuhusu ahadi hii, iseme kwanini haiwezi kujenga mitambo ya kufua gesi Mtwara, na badala yake inang’ang’ania kujenga mabomba ya kupeleka gesi Bagamoyo na Dar es Salaam,” alisisitiza.
Mnyika alisema Kinana ni lazima atoe kauli kama aliyoitoa juzi kwani alikuwa ni sehemu ya uongozi wa bodi ya wakurugenzi ya Kampuni ya Artumas na alishiriki kuwakosesha wananchi wa Mtwara fursa ya umeme wa MW 300 zilizopaswa kuzalishwa Mnazi Bay tangu 2009.
“Kinana badala ya kujifanya kuwatetea wananchi wa Mtwara awaeleze alilipwa kiasi gani na kampuni hiyo na kwanini hakutetea maslahi ya wananchi toka wakati huo,” alisema.

Course participants from the National Defence College of Tanzania met with the management of Tanzania National Parks and discuss various issues related to tourism sector and its implications to the national security.
A delegation of six senior officials from various government organs were briefed by the Director General of TANAPA Allan Kijazi that currently TANAPA is embarking on exploring new emerging markets of Russia; Japan; China and India where Tanzanian embassies have been financially facilitated to promote tourist attractions in the parks and thus be able to attract more visitors.
During the discussion the delegation was eagerly to know on the status of the poaching crisis in the parks. Mr. Kijazi briefed the course participants that poaching has now moved from subsistence poaching to commercial poaching where there is now an international network which facilitates poaching activities by offering substantial amount of money and other necessary resources. The already available market for the poached stuffs also triggered the crisis.
However, a delegation from NDC was told that TANAPA is currently putting more emphasis on the intelligence aspect which helps in gathering information regarding poaching to as far as outside its boundaries as a proactive initiative. “We are also equipping our park rangers with modern techniques by conducting trainings as well as buying them modern weapons to use in the field” said Kijazi.
National Defence College is an inter-service (defence-civil) which was established with an aim to equip Defence and Government policy markers with requisite economical; political; military; scientific; international relations and national knowledge necessary for understanding of national security in its internal and external dynamics.

Zanzibar exports increase in 2012

Zanzibar’s exports of goods and services during the year ending October 2012 increased to USD 159.9m from USD 155.1m recorded in corresponding period last year, the Bank of Tanzania has said in its monthly economic review for November.
Clove exports rose from 1,500 tonnes in the year ending October 2011 to 3,500 tonnes during the year under review.
However total value of imports of goods and services during the year ending October, this year also rose to USD 313.4m, from USD 219.1m recorded during the corresponding period in 2011, mainly due to a rise in the value of capital goods for infrastructure development, specifically importation of the new marine cable to replace the current one connecting Zanzibar to the national grid from Dar es Salaam.
Services account registered a surplus of USD 32.3m in the year ending October 2012, compared to a surplus of USD 30.8m recorded in the corresponding period in 2011.
The review said service receipts increased by 10.4 percent from USD 125.0m to USD 138.0m, while service payments increased to USD 105.7m from USD 94.3m.
Government expenditure during the month under review, amounted to 48.0bn/- , out of which recurrent expenditure accounted for 49.1 percent and the balance was development expenditure.
Wages and salaries and other charges amounted to 10.9bn/- and 12.7bn/- respectively while development expenditure amounted to 24.5bn/- above the estimate by 93.1 percent, mainly on account of increased inflows of foreign grants for development projects.
Out of the total development expenditure, the review said foreign funded component accounted for 67.8 percent and the balance was local contribution.
During the year ending October 2012, current account recorded a deficit of USD 46.9m, compared to a deficit of USD 30.0m registered in the year ending October 2011.
The deficit in goods account widened to USD 149.9m in the year ending October 2012, compared to a deficit of USD 94.8m recorded during the corresponding period in 2011.
This was on account of an increase in the import bill, associated with the importation of new marine cable for improvement of electricity supply to Zanzibar, the review stated.
Annual food inflation dropped to negative 0.4 percent in October 2012 from 1.0 percent registered in September 2012, mainly on account of decline in prices of rice and sugar.
However, month-to-month food inflation accelerated to 0.2 percent from negative 3.5percent, registered in September 2012, driven by increase in prices of fish, bread and vegetables.
The review said annual non-food inflation eased slightly to 11.0 percent from 11.6 percent registered in September 2012. Month-to-month non-food inflation also declined to 0.8 percent from 0.9 percent recorded in September 2012, mainly due to decrease in price of items under housing, water, electricity, gas and other fuels sub-group.
Government budgetary operations on cheques issued basis, registered a deficit after grants of 13.8bn/- in October 2012, which narrowed to 5.9bn/- after adjustment to cash.

 President Jakaya Kikwete presses computer key to launch 2012 Population and Housing Census results at Mnazi Mmoja grounds in Dar es Salaam yesterday. The figure displayed on the computer screen shows that Tanzania's population is now 44,929,002. Looking on are Vice President Dr Mohamed Gharib Bilal and Prime Minister Mizengo Pinda.

President Jakaya Kikwete yesterday released preliminary results of this year’s National Population and Housing Census showing that in ten years the country’s population has grown to 44,929,002 from 34.4 million people in 2002.

Of these 43,625,434 people were counted on Tanzania Mainland and 1,303, 568 in Zanzibar.

According to the figures, the population grew by 26 percent over the last ten years, or at the average rate of 2.6 percent annually, which the President described as too big in such a period of time, noting that the population was projected to reach 51 million, in the next four years.

“This figure may not seem to be a problem to the people for such a vast country like Tanzania, but it is burden as it affects the country’s economic development and the community in general,” President Kikwete said.

He said the government will need to come up with development strategies in order to accommodate the present and future population, calling on people to work hard to provide basic needs to their families.

The President also challenged the public to use family planning to control the population growth or else the situation could worsen in the future.

He said while the government will strive to provide important services needed by the population, families must plan the number of children they can take care of within their means.

The President said government will release further information on the country’s population indicating the number of men and women and other groups in the society by February, next year.

He said despite the challenges encountered during the counting, the exercise set to cost a total of 140bn/- has been successful, adding that the government had already spent 124bn/-.

Prime Minister Mizengo Pinda thanked all those who made the exercise succeed, including development partners and wananchi.
He cited a bigger input of local expertise in the preparation and execution of the 2012 population of housing and census.

“We made a promise that at end of December we will release the results and today everybody is here to witness it happen. It was not a simple task, but the close collaboration of the community and other stakeholders from Zanzibar and Mainland enabled us to complete the exercise,” he said
Zanzibar Second Vice President Ambassador Seif Ali Idd said public institutions and organisations should use the population and housing census to bring development in the country and to families.

“The results will have a great meaning if only people use them effectively. I call upon you to increase productivity, add effort in work,” he said
The United Nations Population Fund (UNFPA) Tanzania Representative Mariam Khan, said the census results were an opportunity to adjust development policies and programmes so that the national and global goals set by the government can be met sooner rather than later.

She said the importance of a census cannot be overstated particularly for developing countries like Tanzania with development commitments and agendas that require integration of population aspects into short, medium and long term development plans.

Commenting on the results Prof Ibrahim Lipumba, who is an economist, said the population growth has great impact on the economy, especially on youth employment.

He said it was time the government ensured that the country’s resources were efficiently utilised and proper strategies to solve youth joblessness.

“The President has stressed family planning which is very crucial in addressing this kind of growth rate …people should have children they could manage to provide for in terms of basic needs,” Prof Lipumba said.

A University of Dar es Salaam student Elias John said apart from family planning, there was also need for the government to come up with clear policies to manage the resources of the country.
He said with proper management and utilisation of the resources the country can meet the needs of the growing population without any problem.

Temeke resident Raphael Maganga said the population figure was a threat to the economy because it was difficult for the government to meet the needs of all people. The government needed to come up with plans that will enable its people access important services such as health, education and water among others.
Maganga cited unemployment facing the majority of the youths in the country, wondering how the government would address the problem.

The first census to be conducted in Tanzania took place in 1910. Last four censuses after independence were held in the years 1967, 1978, 1988 and 2002. According to the last census held in August 2002, the population in Tanzania was 34,443,603.

The rapper announced at a concert Sunday night that his girlfriend is pregnant. He told the crowd of more than 5,000 at Revel Resort's Ovation Hall in song form: "Now you having my baby."

Mobile Operating System From Firefox

Google has one, so does Apple. Why not Mozilla Firefox? The popular browser company, which has felt a pinch in market share compared to its Silicon Valley neighbor (and I mean, neighbor--they are next door to each other) Google Chrome, is dipping its toes into the smartphone pool. Claiming it will be cheaper than Android, the Firefox OS might just have a chance: It will support rich content with HTML5 and tap into the hardware in new ways. For example, the OS might control a phone's camera for slow motion recording or quick, successive shots.



Microsoft's Surface Tablet Pro

The tablet with the funky cover/keyboard combo will likely arrive this fall, but the big splash will come in 2013 with the Pro model, which will have a legit Intel i5 dual-core processor. Why is a Microsoft tablet such a big deal? It’s the future of Windows computing, that’s all. Swipes and gestures on the new Metro interface are one thing, but the Office Touch apps might finally make business users pay attention.



Amazon Kindle Phone

Technically this one is still a rumor, though The Wall Street Journal broke the story recently citing unnamed sources. The device might use a 5-inch display that’s similar to the Samsung Galaxy Note or a 4-inch screen that looks like the rumored iPhone 5. Either way, the Kindle Phone would match up nicely with the Kindle Fire and probably will be just as consumer-focused with custom apps for reading books and watching videos.
